Dealing with Outstanding October Dues

If you are still dealing with October dues from 2022 on your account, then this post is meant to be an exhaustive resource to take care of the issue. First, let's understand how we got here.


Why are the October assessments still an issue?

In September 2022, a completely new board took over at Lisle Place. This change occurred because the previous board was found to have violated election rules by Judge Bonnie Wheaton of the DuPage County Circuit. As a result, a court-ordered custodian was appointed to oversee a fair election.


After being removed, the old board deliberately interfered with the new board's operations. The exact reasons for these actions are unclear. One of their disruptive tactics was withholding essential documents from the new board. Despite court orders, they did not hand over all the required documents, including access to the HOA's bank accounts. Consequently, the new board started with only $300 to manage the property.


The new board began investigating the financial situation, unsure of what they would find due to the lack of documentation. Eventually, they discovered previous banking activity with PacWest Bank and contacted them. Board members Joseph Peletis and Garrett Black, along with a legal representative from PacWest, discussed gaining control of the Lisle Place account. During this conversation, they were surprised to learn that a letter had been sent to the bank from the Lisle Place board, likely by a member of the previous board, giving unauthorized instructions about the account. Due to the conflicting information, PacWest decided to turn the matter over to the California courts through an interpleader lawsuit. This action froze the funds in the account for months and cost the homeowners $10,000 to retrieve the money from the California court.


However, this only explains the beginning of the problem. Due to California's strict privacy laws, PacWest Bank is not obligated to provide the property documentation needed to verify the October dues paid into the account. As a result, we still lack the documents necessary to settle the October assessments. The only proof of October payment available is individual bank statements and proof of check payment made in October 2022.


AdvocatePM and Proof of Payment

In an attempt to resolve this issue, the board was advised by Advocate to have homeowners contact them and provide bank statements showing their October dues were paid. Some homeowners succeeded in doing this, while others did not. Regrettably, this issue persists. We are dedicating extra time and effort to resolving it.


We have demanded that Advocate PM take action to rectify the issue and bring it to a close.


Steps to take to have October assessments removed from your account:

  1. Send a bank statement showing the October payment from your account to receivables@advocatepm.com.

  2. If you'd like, CC info@courtyardsoflisle.com so we can follow up on individual cases with APM until they are resolved. If you're not comfortable with this step, you do not need to do it.

  3. If you have received any late fees directly related to the outstanding October fees, send a fee waiver request to service@advocatepm.com and we will waive any and all late fees associated with this issue.
